The Department of Justice has introduced several proposed changes to Section 230 of the Communications Decency Act, specifically aimed at antitrust activity and encryption. Senator Josh Hawley (R-Missouri) also introduced a bill that would allow for citizens to sue Big Tech companies who censor political speech and hide content created by competitors.
In speaking with Law.com, Paven Malhotra observed that “If these proposals are put into place, it could significantly weaken the ability of platforms to defend themselves in the future, because CDA 230 has been a very important tool for platforms to be able to operate their businesses, permit content and do that without incurring punitive legal exposure.”
